Recently, Director Liu Guangchao and Senior Partner Sun Yu of Beijing DOCVIT Law Firm were interviewed by China United Business News (CUBN), in which they analyzed the status quo and difficulties in the investment of insurance funds and gave corresponding solving strategies.


In the first half of this year, relevant persons in charge of China Insurance Regulatory Commission (CIRC) expressed that placards of insurance funds would be subject to continuous concern and monitoring as well as enhanced regulation so as to add early risk warning and control. In the meantime, on September 6, CIRC issued the Notice on Strengthening the Regulation over the Life Insurance Products and the Notice on Matters Regarding Further Improving the Life Insurance actuarial System, which enhanced the regulation over the life insurance products and laid down a series of new regulation rules regarding the universal life insurance products.

Liu Guangchao, Director of Beijing DOCVIT Law Firm, expressed that, since the equity battle between Bao Neng and Van Ke was closely concerned by the market and media, the investment behaviors of insurance funds has become the focus of attention of all walks of life. Being influenced by the equity battle between Bao Neng and Van Ke, some acquired targets have intensified their awareness of preventing the loss of corporate control power; a small wave of implementing the anti-M&A measures appeared among the enterprises listed on the A share market. In the context of overall economic growth slowdown and difficulty in seeking the good assets, it indeed brings certain barrier to the investment economy along with the successive adoption of anti-M&A measures by the invested target enterprises.

Upon speaking of the insurance funds investment market development and future prospect, Liu Guangchao gave his views: “The insurance industry still needs radical reform and cannot ignore the conventional insurance business; it should improve the insurance supply quality, optimize the insurance supply structure, keep a close eye on the national investment policies and market development, and conduct scientific and reasonable forecast of investment prospect so as to prevent the risk of deviated investment ideas. In the investment of insurance funds, it should strictly control the investment risks and avoid high valuation of target enterprises; it should optimize the portfolio and add the long-term assets (including those assets that can live through economic cycles and provide stable cash flow) as well as treasury bonds, financial bonds, etc. In case of inadequate fund risk control ability, the insurance companies may take into account focusing the equity investment in the market on the financial investment, supplemented by the strategic investment. In relation to the strategic investment, financial investment has low risk and short maturity period, and can effectively fulfill the optimized asset allocation structure in a short term.”


Sun Yu, Senior Partner of Beijing DOCVIT Law Firm, stressed that, the insurance institutions may pay attention to the policy orientation and market demand, explore such innovation directions as innovative investment channels, innovative credit enhance modes, innovative product modes, innovative principal business support modes as well as innovative local government cooperative modes.”
